Without Malaysia input, we may have to file closure report: CBI

Even as the CBI on Thursday informed the Supreme Court that unless it proved a quid pro quo in the case of bribery in the Aircel-Maxis deal allegedly involving the former Telecom Minister, Dayanidhi Maran, it might have to file a closure report, the court asked the Indian High Commission in Malaysia to extend full cooperation to the investigating agency in getting the required information.

Senior counsel K.K. Venugopal, appearing for the CBI and the Enforcement Directorate, told a Bench of Justices G.S. Singhvi and K.S. Radhakrishnan, hearing the 2G case, that information from Malaysia was awaited. When Justice Singhvi wanted to know how long the CBI would wait, counsel did not specify any time limit.

He said: “We don’t want to jump the gun. Unless we can link quid pro quo with beneficiaries a case of bribery cannot be made out. Unless we prove the bribery charge with evidence, the [trial] court will throw out the charge sheet. If the vital information is not forthcoming then we may have to file a closure report.”

Justice Singhvi told counsel: “We don’t want you to jump the gun but you [CBI] cannot go on [waiting for information] indefinitely.”

On Wednesday, Mr. Venugopal told the court that a politically and economically powerful person in Malaysia was stalling the probe. So far as the domestic probe was concerned, the CBI had completed its job. Letters Rogatory had been sent to Malaysia and Mauritius to establish a link between the investments (in Sun Direct) made by the Maxis group and grant of licence to Aircel and Malaysia had sought certain clarifications.

    The expected thing has happened.CBI which acts according to the dictates of Sonia can’t say otherwise except that they are not able to get any infmn from Malayasia as the details are not available becoz of the influence of a person.Who is that person?SC judges boast that they are monitroing the case.What monitoring?We hear once in a blue moon that Singhvi bench asking for status report from CBI and CBI promptly give something which they must have made months back.In this wauythe 2G casewill be buried under the carpet and all big fishes will escape thru the Grace of Sonia as CBI can’t do anything against her wish.So too Singhvi bench.Ultimately Maran and Kanimozhi will escape just to please Karunandhi whose support is necessary for th survival of UPA for now at least.So Sonia will put pressure on CBI to allow Maran and Kani to escape as she has done in the case of the killers of Rajiv Gandhi by filing mercy petition.No wonder some babus will be punished and perhaps Raja may also face the music as Ganguly order squarely blame Raja only for the 2G scam.MK won’t bother abt Raja as he bothers abt Maran and Kani though initially he made a drama of Dalit factor and Dravidian vs Aryan factor in the case of Raja till Kani was arrested.Now he can spend Raja as of no use.Such is the way CBI and SC work in tandem.for their ow welfare.No wonder CAG wanted that both CBI and CVC shuld be made Constitutional Authorities.In that case they can work fearlessly to a great extent though they can be purchased.That is how Chidambaam by the mercy of Sonia and Singhvi bench never touched PC and exonerated him.Who will beleive CBI and SC?
