NEW DELHI: Rejecting a report of Ahmedabad metropolitan magistrate which states senior police officers killed Ishrat Jahan and three others to win acclaim from Gujarat Chief Minister Narendra Modi, the BJP on Tuesday turned the tables on the Congress and the Congress-led UPA government at the Centre by quoting from the Centre’s affidavit in the Gujarat High Court on August 6, 2009. The affidavit describes Ishrat as a Lashkar-e-Toiba (LeT) operative, and apparently part of a plot to kill Modi. BJP spokesman Ravi Shankar Prasad quoted from the Centre’s affidavit, which states, “Ishrat was actively associated with LeT and apology by LeT mouthpiece is only tactical to discredit Indian security agencies and police and aimed at misleading the court.”BJP deplored the Congress attempts to politicise the issue and demanded that the Centre come clean on the entire episode and publicly explain its position, in the light of an affidavit filed by the Ministry of Home Affairs. The party said that in the fight against terrorism, there had to be unified action and deplored efforts to dilute the issue.Questions were also raised on the propriety of a magisterial probe, when the Gujarat High Court was seized of the matter and an SIT probe was also underway.Ahmedabad Metropolitan Magistrate S P Tamang’s probe report states 19-year-old Ishrat and her three friends were gunned down by Ahmedabad Police’s Crime Branch (Detection) on June 5, 2004, in a “fake encounter”. Ishrat, a resident of Mumbra suburb in Thane district, was a second year B.Sc student at Mumbai’s Guru Nanak Khalsa College. Gujarat has decided to challenge the report. Cabinet minister Jay Narayan Vyas said the report was “bad in law”.

LUCKNOW: Former union minister and Bharatiya Janata Party (BJP) leader Maneka Gandhi has been asked not to meet her son and the party’s Lok Sabha candidate from Pilibhit Varun Gandhi, who is in Etah jail in Uttar Pradesh.
“I want to make it clear we have not issued any prohibitory orders. We have just requested Maneka Gandhi that she should not meet her son Varun as per the jail administration rules,” district magistrate Gaurav Dayal told IANS on phone from Etah, which is 220 km from the national capital.
Varun Gandhi is in jail as he faces charges under the National Security Act following campaign speeches vilifying Muslims that have purportedly been delivered by him.
According to rules, only two meetings with jail inmates are allowed in a week. And in the case of Varun, these two meetings have already been conducted, said Dayal.
Of the two meetings with Varun, the first was organised Wednesday with her mother Maneka Gandhi, while the second took place Thursday with three leaders of BJP, officials said.
“We have just requested Maneka Gandhi that she should not visit this week in the (Etah) jail to meet her son and abide by the general rules of the jail administration,” Dayal added.
“I am nobody to prevent a mother (Maneka Gandhi) from meeting her son.”
According to BJP officials, Maneka was scheduled to arrive in Etah Friday afternoon to meet her son in jail.

Apex court seeks justification for detaining Varun
April 2, 2009NEW DELHI: The Supreme Court Thursday issued notice to the Uttar Pradesh government seeking justification for detaining Bharatiya Janata Party leader Varun Gandhi under the National Security Act (NSA).
A bench of Chief Justice K.G. Balakrishnan and Justice P. Sathasivam, after issuing the notice to the state government, adjourned the matter to April 13 for the next hearing. Varun Gandhi, who was put in jail March 28 for his alleged hate speeches, had Wednesday approached the apex court to challenge his detention under the NSA.
The bench also indicated that releasing Varun Gandhi on bail a few days before the last date of filing nominations from the Pilibhit parliamentary constituency in Uttar Pradesh April 16 should not be a problem.
“The nomination should not be a problem,” observed the chief justice while hearing his lawyer and former additional solicitor general Mukul Rohtagi’s plea to quash the invocation of the preventive detention act, NSA, against his client.
In his plea, Rohtagi cited several alleged illegalities resorted to by the Uttar Pradesh government in invoking NSA against Varun Gandhi.
NSA was slapped against Varun Gandhi for ‘inciting violence’ prior to his arrest in Pilibhit. He was moved to Uttar Pradesh’s Etah jail early Wednesday from Pilibhit for security reasons.

Varun moves SC challenging invoking of NSA against him

BJP leader Varun Gandhi today approached the Supreme Court challenging invoking of National Security Act (NSA) against him by Uttar Pradesh government for allegedly inciting communal tension.
Senior advocate Mukul Rohatgi and Sandeep Kapoor appeared on behalf of Varun before a Bench headed by Chief Justice K G Balakrishnan and sought permission to file the petition.
The Bench allowed their plea that the petition be included in the mentioning list for tomorrow.
The Uttar Pradesh government had booked Varun under the National Security Act on Sunday for the hate speeches.
Notably Gandhi was shifted to a high-security Etah jail last night under heavy security following intelligence inputs that underworld don Chota Shakeel was hatching a conspiracy to kill him.
Intelligence agencies had informed the Uttar Pradesh government a week ago about an intercepted telephonic conversation between Shakeel and one of his key shooters indicating a plot to kill 29-year-old Gandhi, the day he came to surrender at a Pilibhi Court, the sources said.
The details of the conversation between Pakistan-based Shakeel and his key shooter Rashid was provided to the Uttar Pradesh home department with a suggestion to take necessary steps for ensuring security of the leader, the sources said, addding the state police had increased his security while he was on way to surrender at the court.
Rashid was arrested in Karnataka last week while he was planning to make a move to Pilibhit to execute the instruction of the don, they said.
Gandhi has been booked under the National Security Act (NSA) for inciting communal tensions by making provocative and inflammatory speeches during meetings held on March seven at Dalganj and on March 8 at Barkhera area of Pilibhit district.
Meanwhile the imprisonment of BJP Lok Sabha nominee Varun Gandhi over his alleged hate speeches was a warning to Hindus and an attempt to appease Muslim vote bank, Shiv Sena chief Bal Thackeray said here on Wednesday.
“The way the Mayawati government slapped NSA and jailed Varun is a bid to appease Muslim vote bank. It is a warning to Hindus,” Thackeray was quoted in an editorial in Sena mouthpiece ‘Saamana’.
“We can understand that action was taken for his alleged remarks but what is the justification for invoking National Security Act (NSA) and putting him behind bars for a year,” Thackeray said.
How could Indira Gandhi’s grandson pose a danger to the country, the Sena chief asked.
“If what he said poses danger to the country then arrest 80 crore Hindus under NSA,” he added.
“Nobody ever thought it was a danger to the country’s security when Sonia Gandhi continued to live in Indira Gandhi’s household for 17 years without accepting Indian citizenship,” he said.
“Lakhs of Bangladeshis illegally enter India. Congressmen make them voters and win polls. Nobody thinks that the rapidly multiplying population of Muslims who abhor family planning is a threat to national security. But a youth who is yet to grow a moustache is termed a threat to the country,” Thackeray said.

Varun Gandhi moves SC against ‘illegal’ detention

NEW DELHI: Bharatiya Janata Party’s (BJP) candidate in Pilibhit Varun Gandhi, in jail for his alleged hate campaign speeches, on Wednesday approached the Supreme Court to challenge his detention under the National Security Act (NSA).
Varun Gandhi, who was moved to Uttar Pradesh’s Etah jail early Wednesday from Pilibhit, was being held illegally by the state government, his lawyer, former additional solicitor general Mukul Rohtagi, told a bench of Chief Justice K G Balakrishnan.
The bench assured Rohtagi that it would hear his petition on Thursday.
Rohtagi told the bench that he was in the process of filing a habeas corpus petition to bring Varun Gandhi to the court. The habeas corpus special petition is filed when a person goes missing and foul play is suspected.
Varun Gandhi was arrested and later booked under the stringent NSA by the Uttar Pradesh government for “inciting violence” prior to his arrest on Saturday.
Dreaded gangster Chhota Shakeel had ordered the elimination of Varun Gandhi the day he was to surrender at a Pilibhit court, according to the Intelligence Bureau which intercepted a telephonic communication on March 21 from the Karachi-based don for this ’special assignment’ to his key shooter Rashid Malbari. The IB had alerted the UP home department on March 22, after which Varun’s ‘on-way’ security was doubled.
Malbari, alias Double, was arrested in a joint operation of the IB and Karnataka’s Department of Criminal Intelligence Bureau in Mangalore on March 27 while he was preparing to move to Pilibhit via Delhi.

PILIBHIT: BJP candidate Varun Gandhi lodged in the district jail after being remanded in judicial custody over hate speech during election campaign has been shifted to another jail due to security reasons, official sources said.
Gandhi was shifted to Etah jail last night. He was moved out due to security reasons, the sources said, adding that he was flooded with a number of visitors in Pilibit.
Varun has been booked under the National Security Act (NSA) for inciting communal tensions by making provocative and inflammatory speeches during meetings held on March 7 at Dalganj and on March 8 at Barkhera area of Pilibhit district.

To kill a mocking bird Bane of being Hindu
April 1, 2009The country’s politics has become minority centric. This facet comes into sharper focus at the time of election because that is the occasion to decide the destiny of the country. Varun Gandhi would have got away unnoticed had he said all that he had allegedly said to protect the Muslims or even a Kasab, Shahabuddin or Mohammad Afzal instead of the Hindus. The issue is not the use of religion in politics but the use of wrong religion on a right occasion.
If Sonia Gandhi goes to Tirupati, or Guruvayoor—these temples are not open to non-Hindus and after her visit the temple priests conduct elaborate purification rites—though she is a Catholic it is not for vote but a generous fashion parade of secularism. Look at the Congress manifesto. Or the Trinamool Congress manifesto. Both have chapter and verses of promises for specific religious groups(not Hindu) and by all interpretations the crux of their promise is a separate religious charter exclusively to woo minority vote bank. (This is a clear violation of the Constitution. ) Not only that. They are highly patronising to terrorists. The Congress manifesto claims to have defanged the security forces fighting terror by repealing POTA. The Congress manifesto was released on the day twelve brave Indian soldiers lost their lives in Kashmir fighting the Lashkar infiltrators. The country has lost over 7000 innocent citizens in terror attacks in the last five years as part of the Jehadi design to inflict a thousand cuts to destroy India. But the Congress manifesto is silent on fighting terror. Rather it claims terrorists have no religion. Terror patrons in the country are honourable men. They are the torch-bearers of secularism.
The Congress is openly seeking the support of ulemas of Deoband, Jamaat-e-Islami and Maulavis of Bahralvi, Imam of Jama Masjid and Bangladeshi infiltrators on purely communal lines. But neither the Election Commission nor the media accuses it of communal politics. The media does not expose them either. In Mizoram, Nagaland and other North-eastern states, the Congress plays Christian card promising the land of the Bible, but it gets away in the name of secularism. Any number of Bishops have written to the Congress high command demanding tickets for their nominees and many of them were given ticket.
More blatant is the crass minorityism cynically being promoted by the CPI(M), Samajwadi Party, BSP and others. CPM’s closest ally in Kerala is Madani, a religious fanatic whose links with various terrorist incidents in the country is well-known. Another fanatic leader who wants to introduce shariat in the country, Kantapuram Musaliar is a bosom ally who is canvassing for the CPM. All these people are known for their communally charged vitriol.
A report from Uttar Pradesh said the Samajwadi Party and BSP together have fielded nearly fifty candidates with serious criminal record, mostly from the minority community and it is likely as many as two dozen of them would enter Lok Sabha. The Samajwadi Party which defended terrorists from Azamgarh who attacked Delhi and insulted the memory of the slain police officer MC Sharma by offering his widow a fake cheque has no qualms about its crass communal politics. All these go scot-free not only because the Constitutional authorities are biased, but also because the political milieu in the country is such that only the word “Hindu” is objectionable and communal.
For people holding Constitutional posts their religion comes first, if they are not Hindu. Vice President A R Ansari recently advocated separate budgetary provision for Muslims. Nobody objected. Perhaps he was not satisfied with Sachar Committee, separate ministry, quota and scholarship for Muslims. But even a “Hindu” tag is detrimental to a person’s political progress. We have seen it at the time of Presidential election when both Shivraj Patil and Dr. Karan Singh were rejected only because they happened to have a Hindu tag. If Varun Gandhi had spoken in the name of any particular caste, then also no charge-sheet would have been filed. After all caste politics also is passé.
Varun is the first Gandhi to declare that he is a proud Hindu. So he is in trouble. Tomorrow if he joins the SP, BSP or Congress he will immediately be paraded as a secular messiah. It would become natural, that the scion of the Nehru-Gandhis has returned to where he belonged, the pro-establishment media will take no time singing paeans for him. For instance, they have no quarrel with Narayan Rane, Chagan Bhujbal or even Raj Thackarey all former Shivsainiks who were riled by the media as long as they were in the Shiv Sena.
The point is that all the breast beating and moral indignation and trial by media are exclusively reserved for the BJP. It is because Varun is the BJP candidate. The model code of conduct has been specially sharpened and imposed retrospectively with the Election Commission working overtime. The alleged speech actually was made weeks before the code came into operation. The EC has always displayed a double standard in the case of the BJP and other parties. This we have seen during the Gujarat assembly election when it acted hastily in the complaint against Narendra Modi even as it let Sonia Gandhi off the hook with her mout ka saudagar innuendo. “We are testing the waters” a senior EC official reportedly said of EC’s advice to the BJP asking it to drop Varun as a candidate. It is a dangerous precedent it was trying to push. The EC cannot have been more careless with the choice of words. Did it intent to intimidate the party into following a particular line? The EC has not taken a view on complaints filed many days before the complaint against Varun was filed. It is similarly slow and silent—the media is equally co-operative by indifference—on all other instances of violations. But the EC was “seized” of the Varun case ever since it came to light. And when the Commission pronounced its order one channel claimed credit for the “impact” its expose had. Advising Varun on reading Bhagwat Gita Priyanka Vadra Gandhi was repeatedly shown as coming out of a Hanuman temple as if that was of essence. If a non-Hindu pretending to be a religious Hindu goes to temple on poll eve it is only to hoodwink the voter. Gita of course is not a treatise on pacifism for Priyanka to advise Varun to read it. It can only strengthen his conviction. It is more a doctrine of war against evil, to protect one’s dharma even if that brings death. Perhaps Ms Vadra might have thought the Gita read like the Bible.
It is time Sonia Gandhi and her family declared their faith. A Nehru-Gandhi in the eye of the dominant establishment in the country can be a Catholic, a Parsi, an atheist or a Muslim and they will automatically be declared “secular” by the servile, obnoxiously bootlicking media. But to be a Hindu is blasphemous. They bay for blood. They want the abrupt termination of a budding political career, they are so unforgiving, vindictive, vengeful and mercilessly cruel.
Varun’s reported views can also be taken as a first mistake of an over-enthusiastic debutant politician. Should a promising young career be so cruelly nipped in the bud invoking even the name of his father who was tragically killed orphaning him when he was only two months? Our chattering class like the proverbial wolf wants to punish him for the alleged omissions and commissions of his father also. Like a lynch mob they create the macabre atmospheric for the partisan establishment to convict and crucify. So we stand by anybody and everybody who speak for the Hindu. Because we want to make Indian polity Hindu centric.

Talking to TOI, the septuagenarian leader said the issue reminds him of gross misuse of Maintenance of Internal Security Act (MISA) during the emergency period against political opponents.
Malviya, however, agreed that whatever Varun spoke was anti-national but added there was no need to invoke NSA against him without a fair trial. He said that when veteran Kashmiri leader Sheikh Abdullah was detained under the Preventive Detention Act (PDA), the great socialist leader Ram Manohar Lohia had vehemently opposed the same and exhorted the countrymen to observe “Sher-e-Kashmiri Diwas” in protest against the illegal detention.
When Malviya’s attention was drawn towards the fact that his statements may send wrong signals in his own party, the veteran leader said that his party spokesperson had publicly admitted that invoking the NSA was the sole prerogative of the state government
but the Congress party condemns the alleged remarks of Varun.
He exuded confidence that his comments on the issue would not create any misunderstanding in his party and clarified that he has no intention to offend the party high command by issuing such statements.
Meanwhile, at a meeting of newly founded Varun Gandhi Fans Association held under the presidentship of Ratan Khare the speakers described the young leader as the future of the country.

THIRUVANANTHAPURAM: Booking Varun Gandhi under the National Security Act (NSA), while sparing people such as PDP leader Abdul Nassar Madhani and SIMI leaders, is undemocratic and amounted to double standards, BJP vice-president Venkaiah Naidu said on Tuesday.
“It is a question of misusing the provisions of the NSA. He (Varun) made a speech which is yet to be verified as right or wrong. Why is the NSA not being used against Madhani or the SIMI leaders?” asked Naidu in a press conference here on Tuesday.
He charged UP Chief Minister and BSP supremo Mayawati of trying to consolidate minority votes by targeting Varun Gandhi over his alleged hate speech. Naidu said that if Varun’s speech was objectionable, there were provisions under the IPC to act against him.
He said that the Election Commission had no jurisdiction on a person before filing nomination papers. “You can act against Varun under the law, but not under electoral law,” he said.
CPM state secretary Pinarayi Vijayan also came under attack from Naidu for sharing a platform with Madhani at Ponnani. “Who said he (Madhani) is a changed man? CPM may be saying so. But Madhani is not saying so. It’s the people, who say he is a changed man, who have changed,” Naidu said in reply to a question.
Advani equates Varun’s arrest to Emergency era

Senior BJP leader L K Advani has drawn a parallel between the arrest of Varun Gandhi under NSA and imprisonment of leaders like Jay Prakash Narayan and Atal Bihari Vajpayee during the Emergency.
“I remember the Emergency when great patriots like Jai Prakash Narayan, Morarji Desai, Atal Bihari Vajpayee were arrested under MISA contending that they were a threat to national security,” he said referring to the Varun Gandhi episode in an interview to Zee News.
Advani said Varun’s arrest was a work of “perverse mentality” and the people of the country would not forgive such an act.
“Nothing can be more perverse than using NSA during elections… people should not forget that elections were conducted after Emergency and those who were jailed had won,” he said.
Advani said the Congress’ attempts to call him the scriptwriter of the Varun episode as an act of “desperation and surrender.”
The National Security Act was invoked against Varun, who had been booked for making anti-Muslim speeches, last Sunday.

March 29, 2009JAMMU: Bharatiya Janata Party (BJP) president Rajnath Singh Friday asked the Congress party to explain what had happened to its promise to rebuild the Babri mosque in Ayodhya.”I want to ask both Prime Minister Manmohan Singh and Congress president Sonia Gnadhi as to why they have not been able to construct the Babri mosque, which they had promised more than one and a half decade ago,” Singh said, addressing a public rally at the Parade Ground here.The BJP chief launched his party’s poll campaign for Jammu. The BJP has fielded the Shri Amarnath Sangharsh Samiti’s former comvenor Leela Karan Sharma from the Jammu-Poonch parliamentary constituency.Singh scoffed at the prime minister’s charge that the BJP’s prime ministerial aspirant L.K. Advani was involved in the demolition of the Babri mosque in December 1992, saying, “What is the prime minister up to?”"Now I have a question. The Congress had promised to build the Babri mosque. What happened to that?”He urged the people to vote for the BJP to “save the nation”.
