A bench of Delhi High Court comprising Acting Chief Justice A K Sikri and Justice Rajiv Sahai Endlaw disposed of the plea of Dr.Swamy saying Swamy has himself not alleged any misuse or tampering of the current system. This is a vicious argument. The judge wants Dr.Swamy to prove that at such and such ward some 10000 people voted for a particular candidate but the EVM regisered the votes in favour of a rival candidate. Who on earth can prove this? Where is the protection of confidentiality of those who exercise their franchise if we are to satisfy the judges?
Secondly the judges have blatantly refused to uphold the law that requires that an electronic devise if used should give a receipt such as when you go to the bank machine and withdraw fifty rupees it must give a receipt saying that you withdrew fifty rupees and your balance in the account is so many rupees. If there was no receipt then you would not know that the machine gave you fifty rupees as you required but debited your account with 500 rupees! Instead the judges expressed some unexplained difficulty in directing the Election Commission to have a paper trail of elections conducted through EVMs. This is a total cop out!
As a sop the bench, however, suggested that the Commission could hold wider consultations with the executive, political parties and other stake holders on the matter.
Yes, it is a suggestion not an order! You know what the EC is going to do in this case.

It is not a surprise.Most of the judges of High Courts and some of the SC are corrupt and lumpens of Sonia Congress.So naturally nothing meritorious verdict can be expected.There was a time the judges were impartial in their assessments but those days are gone.Now we have only Sonia men packed everywhere and so unless this Govt is hown the door nothing tis going to happen and the judges will find ways to block giving sensible judgemenst and always favour the Congress.IN UP ther wil surely be a conspiracy of Congress and EC to get Congress to power and the opposition parties shoul;d be vigilant ound the cock to thwart any attempt and see the boxes are not tampered.It is also ridiculous that judges advised EC to look into the ways by discussion as a sop to Dr.Swamy.What a demoralised judiciary?
